Terms of Service

Effective Date: January 7, 2026.

1. Introduction and Acceptance of Terms

These Terms of Service ("Terms") are entered into between you and Philip Healy, an individual based in Ireland, who operates the Service (the "Operator", "I", "me", or "my").

These Terms govern your access to and use of the decisionpoint.io website, application, and related services (collectively, the "Service").

By accessing or using the Service, including by creating an account or using any free features, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

If you are using the Service on behalf of a business or other organisation, you represent that you have the authority to bind that entity to these Terms.

2. Definitions

  • "Service" means the decision-support software and related features made available by the Operator.
  • "User" means any individual or entity that accesses or uses the Service.
  • "Free Features" means features made available without charge.
  • "Paid Subscription" means access to additional features in exchange for a subscription fee.
  • "Outputs" means analytical results, rankings, scores, or other information generated by the Service based on user inputs.
  • "User Content" means any data, information, or materials submitted to the Service by a User.

3. Eligibility and Accounts

You must be at least 18 years old to use the Service.

You agree to provide accurate and complete information when creating an account and to keep your account credentials secure. You are responsible for all activity that occurs under your account.

4. Description of the Service

The Service provides tools to assist users in structuring and analysing decisions, including through the Analytic Hierarchy Process (AHP).

The Service is intended to support decision-making processes by organising inputs and generating analytical Outputs. The Service does not make decisions for you and does not replace human judgment.

5. Free Features and Paid Subscriptions

Some features of the Service are available free of charge, while others require a Paid Subscription.

The Operator reserves the right to add, modify, limit, or discontinue Free Features or Paid Subscription features at any time.

Access to Paid Subscription features is licensed, not sold.

6. Subscriptions, Fees, and Payments

Paid Subscriptions are offered on a monthly or annual basis. Current prices and billing terms are displayed at the time of purchase or on the Service's pricing page.

Subscriptions automatically renew at the end of each billing period unless cancelled before renewal.

You may cancel your subscription at any time. Cancellation will take effect at the end of the current billing period. Fees already paid are non-refundable except where required by applicable law.

Payments are processed by third-party payment providers. The Operator does not store full payment card details.

7. Discounts, Promotions, and Complimentary Access

The Operator may, at their discretion, offer discounts, promotions, or complimentary access to certain Users.

Such offers:

  • Are discretionary and non-transferable
  • May be time-limited
  • Do not create an entitlement to future discounts or free access
  • May be modified or withdrawn at any time

Complimentary or discounted access does not increase the Operator's obligations or liability.

8. Taxes and Currency

Prices may be displayed exclusive of applicable taxes unless stated otherwise. You are responsible for any taxes, duties, or charges imposed by your jurisdiction.

If currency conversion is required, exchange rates are determined by the payment provider.

9. Acceptable Use

You agree not to:

  • Use the Service for unlawful purposes
  • Interfere with or disrupt the Service
  • Attempt to reverse engineer or misuse the Service
  • Use the Service in violation of these Terms

10. Restricted Uses

The Service must not be used for:

  • Medical diagnosis, treatment, or healthcare decisions
  • Legal advice or legal decision-making
  • Investment, trading, or financial advice
  • Safety-critical, life-critical, or emergency decisions
  • Regulatory or compliance determinations

Any such use is strictly prohibited and at your own risk.

11. User Content and Data

You retain ownership of your User Content.

You grant the Operator a limited, non-exclusive licence to use your User Content solely to operate and provide the Service.

You are responsible for the accuracy, completeness, and legality of your User Content.

12. Intellectual Property

The Service, including all software, design, and underlying technology, is owned by the Operator or licensors and is protected by intellectual property laws.

No rights are granted to you except as expressly set out in these Terms.

13. Decision-Support Disclaimer

The Service provides decision-support information only.

Outputs generated by the Service:

  • Are informational and analytical in nature
  • Do not constitute advice of any kind
  • Do not guarantee correct, optimal, or suitable outcomes

You are solely responsible for evaluating Outputs and for any decisions or actions taken based on them.

14. Bugs, Errors, and No Warranty

The Service is provided "as is" and "as available".

The Service may contain bugs, errors, inaccuracies, or calculation faults. Outputs may be incorrect or incomplete.

The Operator does not warrant that the Service will be accurate, reliable, uninterrupted, or error-free.

15. Limitation of Liability

To the maximum extent permitted by law:

  • The Operator shall not be liable for indirect, incidental, consequential, or economic losses, including loss of profits, data, or business opportunities.
  • The Operator's total liability arising out of or relating to the Service shall not exceed the total fees paid by you to the Operator in the 12 months preceding the event giving rise to the claim.

Nothing in these Terms limits liability that cannot be excluded under applicable law, including liability for death or personal injury caused by negligence or for fraud.

16. Indemnification

You agree to indemnify and hold harmless the Operator from claims arising out of:

  • Your misuse of the Service
  • Your violation of these Terms
  • Your use of the Service for prohibited purposes

17. Suspension and Termination

The Operator may suspend or terminate your access to the Service at any time if you violate these Terms or if your use presents risk to the Service or others.

You may stop using the Service at any time and may cancel subscriptions as described above.

18. Changes to the Service or Terms

The Operator may update the Service or these Terms from time to time.

Material changes will be communicated through the Service or by other reasonable means. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

19. Governing Law and Jurisdiction

These Terms are governed by the laws of Ireland.

Nothing in this section affects mandatory consumer rights under applicable law.
